This website, including any subsite accessible through the site, (referred to collectively as ‘the Site’) is published and maintained by Gin and Tonic Productions ("G&T"). When you access, browse or use the Site you accept, without limitation or qualification, the terms and conditions set out below and any additional terms and conditions of use set out in any subsite.

1. Copyright

Copyright or similar rights in all design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software and all other material on the site is owned by G&T. All rights reserved.

You may view this website on your computer screen and print its contents on your printer for your personal and non-commercial use only. In addition, where G&T so specify on the website, you may download material and save it to disc again for your personal and non-commercial use only. Without the written consent of G&T, you may not use, transfer, copy or reproduce any part of the content on the Site or its source HTML code in whole or in part, in any form or by any means, electronic, mechanical or otherwise, except for the sole purpose of viewing its contents. This includes electronic reproduction by uploading or downloading.

You warrant that it is legal for you to view the Site in the jurisdiction to which you are subject. You are responsible for compliance with all laws of that jurisdiction, in viewing or using the content.

2. Trade marks

”Gin and Tonic Productions”, “Gin and Tonic Films”, logos and other products referenced on the site are trademarks of G&T or its affiliated companies in the UK and/or other countries. Other products or company names referred to on the Site may be trademarks of their respective owners.

3. Use of email a friend and ‘share’ functions

3.1 Description

G&T are providing users of the Site with a capability to send electronic mail via the World Wide Web on the ‘Share’ facility. You must: (1) provide all equipment, including a computer and modem necessary to establish a connection to the World Wide Web; and (2) provide for your own access to the World Wide Web and pay any telephone service fees associated with such access.

3.2 User Conduct

You are solely responsible for the contents of your transmissions through the share facility. Your use of the share facility is subject to all applicable European and UK national laws and regulations.

You agree not to:-

1. Use the share facility for chain letters, junk mail, spamming or any use of distribution lists to any person who has not given specific permission to be included in such a process.

2. Transmit through the share facility any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature

3. Use the share facility for illegal purposes.

You recognize and accept that the share facility provided by G&T is not intended to be an anonymous Email service. Every share made includes the IP (Internet Protocol) address from which the login session originated. With this header information, the source of a message can be narrowed dramatically (often directly to your computer). This is done for the protection of recipients of any shared content.

3.3 Privacy policy

G&T will not monitor, edit, or disclose the contents of your private communications unless required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on G&T; (2) protect and defend the rights or property of G&T; or (3) act under exigent circumstances to protect the personal safety of its users or the public.

You acknowledge and agree that G&T neither endorse the contents of any user communications nor assume responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom or any crime facilitated thereby.

You acknowledge and agree that certain technical processing of Email messages and their content may be required to: (1) send and receive messages; (2) conform to connecting networks' technical requirements; (3) conform to the limitations of the E-card facility; or (4) conform to other similar requirements.

G&T assume no responsibility for the deletion or failure to store shared messages.

3.4 Indemnification

You agree to indemnify and hold G&T, their parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including attorneys' fees and costs, made by any third party due to or arising out of your use of the share facilty.

4. Disclaimers

4.1 General

The Site is provided on an ‘as is’ basis. To the fullest extent possible at law, G&T hereby exclude any warranty, express or implied, as to the quality, accuracy, timeliness, completeness, performance or fitness for a particular purpose of the Site or any of its contents. Except as specifically stated on the Site, to the fullest extent permitted at law, G&T will not be liable for any direct, indirect, consequential or incidental damage or loss of any kind (including, without limitation, loss of profits, business interruption, loss of or corruption to business information or data, damage to business equipment or assets or economic loss of any other form), however caused, arising in contract, tort or otherwise from the use of or inability to use the Site, or any of contents of the Site or for any claim by a third party. For the avoidance of doubt, G&T does not limit its liability for death or personal injury to the extent only that it arises as a result of the negligence of G&T, its affiliates, directors, employees or other representatives.

G&T makes no warranty that either the contents of the Site or the server that makes the Site available are free from infection by viruses or anything else which has contaminating or destructive properties.

4.2 Links
The Site may contain links to other internet sites on the World Wide Web. G&T provide such links for your convenience only, and are not responsible for the content of any site linked to or from the Site. Links from the Site to any other site do not mean that G&T approves of, endorses or recommends that site. G&T disclaim all warranties, express or implied, as to the accuracy, legality, reliability or validity of the contents of any other site.

5. Governing Law and general provisions

The Site and these terms and conditions will be governed by English Law. The English courts will have exclusive jurisdiction over any disputes arising in relation thereto. If any part of these terms and condition is found void and unenforceable, it will not affect the validity of the balance of these terms and conditions, which shall remain valid and enforceable.
